These are the terms you accept when you create a Moment49 organizer account. By creating an account or creating an event, you agree to these Terms & Conditions, which govern your use of our service as an event organizer.

• You are responsible for keeping your account credentials secure and for all activity under your account.
• You must provide accurate information when creating an account.
• You must be at least 18 years old to create an organizer account.
• You may not share your account or use our service to impersonate another person.

You may use our service for lawful purposes only. You agree not to:

• Use the service in any way that breaches applicable law or regulation.
• Attempt to gain unauthorised access to, disrupt or interfere with the service, its servers or any systems connected to it.
• Introduce viruses, malware or other malicious code.
• Scrape, copy or republish our website content without our written permission.
• Use the service to send unsolicited or promotional communications.

We reserve the right to remove content or restrict or suspend access to the service at our discretion, including where content breaches these terms.

• Setting up an event is free; a one-time payment is charged when you take an event live and share it with guests.
• Your event is private. It is accessible only to you and the guests who have your event code, unless you choose to share content elsewhere.
• Guests do not need an account to upload photos, videos, guestbook notes or video messages.
• By uploading, your guests are subject to our Attendee Terms and Conditions. You are responsible for making your guests aware of those terms, for instance by sharing the event QR code or link.
• The upload window is determined by your event's start and end dates (up to 7 days). After the window closes, guest uploads stop but you keep full access to download your gallery.
• You are responsible for the content shared at your event.
• As an event organizer, you are responsible for ensuring you have your guests' permission to collect and share their content through your event.
• All media uploaded to your event is stored for 90 days after the event's end date. After 90 days, all event data, including photos, videos and guestbook entries, will be permanently and irretrievably deleted from our servers. It is your responsibility to download your media before this period expires.

• You and your guests retain ownership of the photos, videos, notes and messages you upload.
• By uploading content, you grant Moment49 a non-exclusive, worldwide licence to host, store, display and process that content solely as needed to operate the service for you (including displaying it in your event gallery, live slideshow, guestbook and photo booth mode, and enabling downloads).
• You confirm that content you upload is accurate, lawful and does not infringe the rights of any third party.
• We may remove or block content that breaches these terms or applicable law, at our discretion.

The Moment49 platform, including its designs, graphics, logos, text and software, is owned by or licensed to MINT49 LTD and is protected by UK and international intellectual property laws. You may not reproduce, distribute, modify or commercially exploit any part of the platform without our prior written consent.

• Events are charged as a one-time, non-refundable payment per event, in your local currency where supported. Prices shown at checkout are the prices you pay; there are no subscriptions or hidden fees.
• A one-time payment activates a 7-day active period for guest uploads. Event extensions can be purchased for an additional fee.
• Sponsored events are exempt from payment.
• Payments are processed securely by our payment providers. We do not store your card details.
• We reserve the right to change prices at any time, but the price shown when you take your event live is the price that applies to your event.

We aim to provide the service continuously but cannot guarantee uninterrupted or error-free availability. We may suspend the service for maintenance or updates. Your event's upload window is not paused or extended for downtime.

• Moment49 is provided on an 'as is' basis.
• To the fullest extent permitted by law, we shall not be liable for any indirect, incidental or consequential loss or damage arising from your use of the service, including loss of content where backups could not be recovered.
• Our total liability for any claim arising out of or in connection with the service shall not exceed the amount you paid for your event.
• Nothing in these Terms excludes or limits liability that cannot be excluded under UK law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

Your use of the service and personal information are governed by our Privacy Policy, which forms part of these Terms & Conditions.

We may update these Terms & Conditions from time to time. Any changes will be published on this page together with the revised "Last Updated" date. Your continued use of the service after changes are made constitutes acceptance of the updated terms.

These Terms & Conditions are governed by the laws of England and Wales. Any dispute arising in connection with them shall be subject to the exclusive jurisdiction of the courts of England and Wales.
